That distinction matters when shoppers see products described as hemp flower, CBD flower or low-THC cannabis flower.

Is CBD Flower Legal In The UK?
The Home Office states that cannabis is a Class B controlled drug and that the legal definition covers the plant and its parts with limited exceptions for the mature stalk, fibre produced from the mature stalk and seed.
That means cannabis flower and leaves remain controlled material. A product being described as “CBD flower”, “hemp flower” or “low THC flower” does not by itself remove those controls.
Anyone dealing with possession, supply, import, export or production of cannabis flower should rely on current official guidance and obtain appropriate legal advice where necessary.
The 0.2% THC Figure Does Not Make Flower Automatically Lawful
A common misconception is that cannabis flower is lawful in the UK whenever it contains less than 0.2% THC. That is not how the Home Office guidance works.
The low-THC industrial hemp regime concerns licensed cultivation for permitted uses of non-controlled parts of the plant, principally seed and fibre. The Home Office states that the industrial-hemp licence does not permit use of the flowers or leaves.
For consumer CBD products more broadly, controlled-cannabinoid rules are also more detailed than a simple “under 0.2% THC” statement. Product-specific compliance needs to be assessed against the relevant legal framework.
CBD Is Not The Same Thing As Cannabis Flower
CBD, or cannabidiol, is one compound found in the cannabis plant. Pure CBD as an isolated substance is not controlled under the Misuse of Drugs Act. Finished consumer CBD products can nevertheless be subject to several other requirements depending on their format, ingredients and controlled-cannabinoid content.
Cannabis flower is different because the flower itself is a controlled part of the plant. That is why a bottle of CBD oil or a CBD gummy cannot simply be treated as legally equivalent to a dried cannabis flower product.
What About Industrial Hemp?
Industrial hemp cultivation in the UK requires a Home Office controlled-drugs licence. Current guidance allows licensed cultivation for industrial use of seed and fibre under the relevant regime, but it does not permit the flowers or leaves to be used as ordinary retail material.
This is another reason shoppers should be cautious when a seller uses the word “hemp” as though it automatically establishes that a flower product is lawful.
