In England and Wales, the FSA's CBD products list is a transitional enforcement list: eligible products may remain on the market while authorisation applications are considered, but list inclusion is not an authorisation or endorsement. Scotland is regulated separately by Food Standards Scotland, which states that no CBD food products have yet been authorised as novel foods in Scotland. In Northern Ireland, the FSA states that CBD food products are currently unauthorised novel foods.
Controlled-cannabinoid requirements are separate from novel-food status, so “less than 0.2% THC” should not be treated as a universal legality test for a finished product.
